Your privacy is important to Magis Capital (Pty) Limited (herein after referred to as “Magis” or “we” or “us”) so we have developed a Privacy Policy that covers how we collect, use, disclose, transfer, and store your personal information. Collection and use of personal information
In its simplest form Personal Information is data that can be used to identify or contact a single person. It includes but is not limited to;
- name, marital status, age, gender, sexual orientation
- contact details including physical address, email address, telephone numbers, location information, online identifiers
- national, ethnic or social origin
- religion, conscience, views, views that other people may have of that person
You may be asked to provide your personal information anytime you are in contact with Magis or business partners of Magis. Business partners of Magis include, amongst others, Financial Services entities in the Insurance, Banking, Asset Management, and Investment Sectors. In addition the Magis business partners include other providers that might already have and / or collect information about you from credit bureaus and various other sources, including government agencies. Some of our major business partners in this regard include, amongst others, TransUnion (Pty) Limited and will in future include the likes of the Association for Savings and Investments South Africa (ASISA). Magis, its affiliates and their business partners may share this personal information with each other and use it consistent with this Privacy Policy. They may also combine it with other information to provide and improve our solutions, services, content, and advertising.
You are not obliged to provide the personal information that we have requested, but, if you choose not to do so, in many cases we will not be able to provide you with our advice, solutions or services or respond to any queries you may have.
What personal information we collect
When you register to interact with us we may collect a variety of information, including your name, national indentity number, residential address, postal address, phone number, email address, contact preferences, device identifiers, IP addresses, location information, bank account details and your income tax number.
In addition to the information about yourself we may ask for personal information about people that you would like covered by our various solutions. We may also ask for details of your next of kin.
We may require copies of government issued identity documents when we set up your profile or those of people that you would like covered by our solutions. We may also require details of your residential information.
How we use your personal information
We may process your personal information for the purposes described in this Privacy Policy, with your consent.
We use your information in the first instance to get the best financial advice and solutions for you. The personal information we collect allows us to keep a record of our dealings with you, our assessment of your financial well-being and status, as well as your financial ambitions and goals so that we can give you the best financial advice and recommended financial solutions. We also use the information to keep you posted on our latest solutions and thinking, and upcoming events.
We may use your personal information, including date of birth, to verify your identity, assist with identification of users, and to determine appropriate services. We may, together with our partners, also use this information for underwriting for insurance purposes.
We may also use your personal information to contact your next of kin in the event of an accident or similar emergency.
From time to time, we may use your personal information to send important notices, such as communications about the services we offer to you and any changes to our terms, conditions, and policies. Because this information is important to your interaction with us, you may not opt out of receiving these communications.
We also use personal information to help us create, develop, operate, deliver, and improve our solutions, services, content and advertising.
We might also use your personal information for compliance with a legal obligation to which we are subject, or for the performance of a contract to which you are party, in order to protect your interests, or when we have assessed it is necessary for the purposes of the legitimate interests pursued by us or a third party to whom it may be necessary to disclose information. We may use your personal information for loss prevention and anti-fraud purposes. We may also use your personal information for account and network security purposes, including in order to protect our services for the benefit of all our clients. Where we use your information for anti-fraud purposes in the case of your conduct in a transaction with us. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect our clients, our services and that of our business partners. For certain online dealings we may also validate the information provided by you with publicly accessible sources.
We may also use personal information for internal purposes such as auditing, data analysis, and research to improve our solutions, services, and client communications.
If you apply for a position at Magis or we receive your information in connection with a potential role at Magis, we may use your information to evaluate your candidacy and to contact you. If you are a candidate, you will receive more information about how Magis handles candidate personal information at the time of application.
Source of your personal information where it is not collected from you
In order to make our services efficient, we may collect some information about you from external sources. These sources include, amongst others, the Department of Home Affairs, the Department of Transport’s National Traffic Information System – NaTIS, Astute Financial Services, TransUnion (Pty) Limited, entities that you may have previously dealt with, and entities with information about your credit records (this list is not exhaustive). We do this to speed up our processes and to improve your experience with us and to get a holistic picture of your financial affairs.
We may receive your personal information from other persons / sources if you were invited to participate in Magis services or forums. We may also validate the information provided by you when creating a Magis profile.
If you are a potential candidate for employment with Magis, we may have received your personal information from third parties such as recruiters or external websites. We will use the personal information we receive to contact you about a potential opportunity or in evaluating your candidacy. If you did not provide us your personal information directly, we will inform you of the source when we first contact you regarding your candidacy.
For research and development purposes, we may use datasets such as those that contain images, voices or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law in the jurisdiction in which the dataset is hosted. When using such datasets for research and development, we do not attempt to re-identify individuals who may appear therein.
Collection and use of non-personal information
We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:
- We may collect information such as occupation, postal code, unique device identifier, age, driving patterns, referrer URL, and location, for people using our services so that we can better understand client behaviour and improve our solutions, services, and advertising.
- We may collect information regarding client activities on our website. This information is aggregated and used to help us develop and refine our client solutions and provide more useful information to our clients and to understand which parts of our website, solutions, and services are of most interest. Aggregated data is considered non‑personal information for the purposes of this Privacy Policy.
- We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevance of results provided by our services. Except in limited instances, to ensure quality of our services over the Internet, such information will not be associated with your IP address.
- With your explicit consent, we may collect data about how you use your device and applications in order to help app developers improve the Magis apps.
- If we do combine non-personal information with personal information, the combined information will be treated as personal information for as long as it remains combined.
Collection of other people’s personal information from you
We will from time to time collect information from you about other people. This may include, amongst others, information about your next of kin, nominated beneficiaries, people for whom you want to take insurance cover for, people who may drive or own vehicles that are insured under your insurance policy. This list is not exhaustive.
We will collect information about other people from you only on the basis that it is in their interest for us to collect their information and that they will not be prejudiced as a result of us having collected and processed their information.
When we collect such information we do so on the understanding that you have the right to share such personal information. In addition, we may contact some of these people in relation to the services for which you gave us their personal information. We may also use their information to communicate our services to them.
The information that we receive on this basis will be treated on the same basis that we treat your personal information.
Cookies and other technologies
Magis’ websites, online services, interactive applications, email messages, and advertisements may use cookies and other technologies such as pixel tags and web beacons. These technologies help us better understand user behaviour, tell us which parts of our websites people have visited, and facilitate and measure the effectiveness of advertisements and web searches. We treat information collected by cookies and other technologies as non‑personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.
We also use cookies and other technologies to remember personal information when you use our website, online services, and applications. Our goal in these cases is to make your experience with us more convenient and personal. For example, knowing your first name lets us welcome you the next time you visit our website or interact with us online. Knowing someone using your computer or device has interacted with us for a certain solution or used a particular service helps us make our advertising and email communications more relevant to your interests. And knowing your contact information, hardware identifiers, and information about your computer or device helps us personalise our technology solution to you, and provide you with better client service.

Disclosure to third parties

We will typically share your information with identified Financial Services Providers whose solutions are used in our solutions and with other third party providers who may be involved in helping us create a better experience for you and those involved in the processing of your claims.
At times we will share personal information with companies who provide services such as information processing, assessing your interest in our solutions and services, and conducting client research or satisfaction surveys. These companies are obligated to protect your information and may be located wherever Magis operates.
Others
It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for us to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you, but only where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or clients. This could include providing information to public or governmental authorities.
In the event of a reorganisation, merger, or sale we may transfer any and all personal information we collect to the relevant third party.
Protection of personal information
We take the security of your personal information very seriously. When your personal data is stored by us, we use computer systems with strong access controls. Electronic data is stored in encrypted form including when we utilise third-party storage.
When you post on a Magis forum, chat room, or social networking service, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share or submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Please take care when using these features.
The existence of automated decision-making, including profiling
Our approach to taking decisions involves the use of algorithms. When we do so any of your personal information is handled in accordance with this Privacy Policy. Similarly, profiling that applies uniquely to you is handled in accordance with this Privacy Policy.
Integrity and retention of personal information
We make it easy for you to keep your personal information accurate, complete, and up to date. We will retain your personal information for the period necessary to satisfy the purposes outlined in this Privacy Policy. When assessing these periods we carefully examine our need to collect personal information at all and if we establish a relevant need we only retain it for the shortest possible period to realise the purpose of collection unless a longer retention period is required by law.
Your privacy rights
You can help ensure that your contact information and preferences are accurate, complete, and up to date by regularly reviewing your profile. On the anniversary of your registration with us we will send you a reminder to review your personal information. We will require a positive confirmation of the accuracy of certain of your personal information every three years.
We may decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes as described earlier. When you make a request using these online tools, we will verify your identity and the legitimacy of your request.
Minors
We understand the importance of financial understanding amongst minors. Much as we will gladly open accounts for minors, a parent or guardian must sign off the information provided by the minor. A parent must review this Privacy Policy and agree to the collection of personal information, before they can contract with us.
Location-based services
To provide location-based services for some of our solutions, we and our partners may collect, use, and share precise location data, including your real-time geographic location including that of your car, computer or device. Where available, location-based services may use GPS, Bluetooth, and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, and other technologies to determine your or devices’ approximate location. Unless you provide consent, this location data is collected anonymously in a form that does not personally identify you and is used by us and our partners to provide and improve location-based solutions and services. Some location-based services offered by our partners may require your personal information for the features to work.
Third party sites and services
Our websites, solutions and services may contain links to third-party websites, products, and services. Information collected by third parties, which may include such things as location data or contact details, is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.
International transfers
All the information you provide may be transferred or accessed by entities around the world as described in this Privacy Policy.
Specific consent to get information from credit bureaus
We are required by law to get consent from you granting us permission to get information about you from credit bureaus.
By accepting to comply with this privacy policy you are giving us consent through our business partner TransUnion, and any others we might use from time to time, to access your consumer credit information held by various credit bureaus to assess your credit risk and to help us determine your credit limits. You also consent to us getting the information from credit bureaus that might help us to update your contact information.
This information enables us to better understand how you conduct your financial affairs and helps us to ensure we deliver solutions that are in line with your own profile.
The National Credit Act requires that we obtain your specific consent when we obtain information about your credit records from credit bureaus directly or through some of our business partners. To this end, our primary business partner is TransUnion (Pty) Limited
Our companywide commitment to your privacy
To make sure your personal information is secure, we communicate our privacy and security guidelines to all our employees, affiliates and business partners and strictly enforce privacy safeguards within the company.
Our relationship with you
By consenting to this privacy policy and using our platforms (apps and website for financial services), you consent to being a client of Magis for all the business initiated on our platforms. You consent to Magis being your Financial Services Advisor in accordance with the Financial Advisory and Intermediary Services Act (Act 37 of 2002). We will also communicate this to the Financial Services Providers that we deal with.
You will still have to agree to the terms of doing business with these financial services providers.
When you decide not to be a client of Magis we will keep your information for as long as we are legally obliged to. In addition, we can contact you for up to three months after the date of your termination.
Privacy questions
If you have any questions or concerns about our Privacy Policy or data processing, please contact our data protection officer, or if you would like to make a complaint about a possible breach of privacy laws, please contact us using one of the channels shown on our website.
Where you have a complaint indicating that an improvement could be made in our handling of privacy issues we will take steps to make such an update at the next reasonable opportunity. In the event that a privacy issue has resulted in a negative impact on you or another person we will take steps to address that with you or that other person.
We may update our Privacy Policy from time to time. When we change the policy in a material way, a notice will be posted on our website and our platform along with the updated Privacy Policy. We will also contact you to inform you of the changes via your chosen way of communicating with us.
